The UP Police today submitted an application before the trial court in Indore for obtaining custody of comedian Munawar Faruqui, who has been in judicial custody there since 2 January. The production warrant is associated with an FIR filed by Ashutosh Mishra on 19 April 2020 in Georgetown, Prayagraj (UP) under sec 195A [Threatening any person to give false evidence], 295A [Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs] and certain provisions of the IT Act.
The complainant took objection to two of Faruquiโs videosโtitled โNawab, Nehru, Gujaratโ and โDawood, Yamraj and Auratโ respectivelyโalleging that the content in these videos could potentially provoke people against the administration, hurt peopleโs religious sentiments and spread communal tension.
The court has so far not passed any order over their application. โIn light of this new development, we have moved the High Court today for an early hearing of the bail application, which is still pending,โ his lawyer Anshuman Shrivastava told DeadAnt. โIf the court grants the UP police custody of Faruqui, then we will be moving an application before the concerned court in Allahabad.โ
Meanwhile the other four persons associated with the comedy show in Indore on 1 Jan will remain in judicial custody in Indore till the next hearing.
