Late comedian George Carlin's estate reaches a settlement with Dudesy, the creators of the AI-generated special 'I'm Glad I'm Dead' that used Carlin's likeness.

George Carlin’s estate has reached a settlement with comedy podcast Dudesy, the creators of the AI-generated special I’m Glad I’m Dead, which used Carlin’s likeness. The hour-long special—released on 9 January this year—took aim at contemporary social and political issues in a Carlin-esque manner, and drew the ire of the late comedian’s daughter Kelly Carlin. “My dad spent a lifetime perfecting his craft from his very human life, brain, and imagination,” she said in a tweet. “No machine will ever replicate his genius.”

The special opens with a voice-over, purportedly by the AI, claiming that it “listened to all of George Carlin’s material and did my best to imitate his voice, cadence and attitude, as well as the subject matter I think would have interested him today.” The estate sued Dudesy‘s hosts, Will Sasso and Chad Kultgen, alleging that the special infringed on their copyrights and their exclusive right to Carlin’s name, image and likeness. Within a week of the lawsuit being filed, Sasso and Kultgen notified the estate that the special had been taken down from their YouTube channel along with any mention on their social media accounts. Following the lawsuit, Sasso’s spokesperson Del admitted that the special was entirely written by Kultgen, rather than the AI that was supposedly trained on Carlin’s previous work.

In a proposal awaiting a Central District of California judge’s approval, Dudesy’s creators agreed to being permanently forbidden from using the special in any form or using Carlin’s likeness in the future without the estate’s approval.

“Our goal was to resolve this case expeditiously and have the offending videos removed from the internet so that we could preserve Mr. Carlin’s legacy and shine a light on the reputational and intellectual property threat caused by this emerging technology,” Joshua Schiller, an attorney for the plaintiffs, said in a statement. “This settlement is a great outcome for our clients and will serve as a blueprint for resolving similar disputes going forward where an artist or public figure has their rights infringed by AI technology.”

“I am pleased that this matter was resolved quickly and amicably, and I am grateful that the defendants acted responsibly by swiftly removing the video they made,” Kelly Carlin said in a statement on Tuesday. “While it is a shame that this happened at all, I hope this case serves as a warning about the dangers posed by AI technologies and the need for appropriate safeguards not just for artists and creatives, but every human on earth.”

The historic 118-day strike by the Screen Actor’s Guild of America had pushed for a federal legislation that would make it illegal to create a fake digital replica of someone without their consent.
